This disclaimer (hereinafter called the “Disclaimer”) governs the use of the services provided via the Internet portal http://www.virtualwaregroup.com (hereinafter called the “Website”) owned by Virtualware 2007 S.A., a company with registered address at Polígono Artunduaga- C/ Usausuaga, 7, 48970, Basauri, Bizkaia, with tax ID number CIF A95291613, duly entered in the Mercantile Register.
Legislation
The relationship between Virtualware 2007 S.A. and the users of its remote services on the Website is subject in general to the legislation and jurisdiction of Spain.
The parties expressly waive any other jurisdictional rights and submit expressly to the rulings of the courts and tribunals of Bilbao for the settlement of any dispute that may arise in the construal or enforcement of these terms and conditions of contract.
Content and use
The User is informed and duly agrees that access to the Website in no way constitutes the commencement of any business relationship with Virtualware 2007 S.A.. The owner of the Website does not necessarily identify with any opinions expressed thereon by its collaborators. As provided for in Basic Act 15/1999 of December 13 on the protection of personal data, Virtualware 2007 S.A. informs Users of the existence of an automated file containing personal data, created by, for and under the liability of Virtualware 2007 S.A. for purposes of maintaining and managing relationships with Users, and providing information. Upon acceptance of these general terms and conditions, the User will be asked by Virtualware 2007 S.A. to provide certain data essential for the provision of its services.
Registration of Files and Forms
To access and use certain services provided via the Website it is compulsory to complete a registration form. Failure to provide the personal details required or to accept this data protection policy will result in the User being unable to subscribe to, register for or participate in any promotion for which personal details are requested.
As provided for in Basic Act 15/1999 of December 13 on the protection of personal data, Virtualware 2007 S.A. informs Users that the personal details provided as a result of User registration will be incorporated into a file owned by Virtualware 2007 S.A. with tax ID number A95291613 and registered address at Polígono Artunduaga- C/ Usausuaga, 7, 48970, Basauri, Bizkaia, and that the security measures envisaged in Royal Decree 994/1999 of June 11 have been implemented.
Accuracy and Truthfulness of Data Provided
The User accepts full liability for the accuracy and truthfulness of the data provided, and exonerates Virtualware 2007 S.A. from any liability in this regard. The User assures and is answerable in any event for the accuracy, currency and authenticity of the personal data provided, and undertakes to keep those data properly updated. The User agrees to provide full and correct information on registration/subscription forms. Virtualware 2007 S.A. provides no assurances as to the truthfulness of any information not drawn up by the Company itself and identified as coming from other sources, and therefore assumes no liability for any harm that might be caused by the use of such information. Virtualware 2007 S.A. reserves the right to update, modify and delete the information provided on its Website, and to limit or deny access thereto. Virtualware 2007 S.A. accepts no liability for any damage or harm that Users may suffer as a result of errors, shortcomings or omissions in information provided by Virtualware 2007 S.A. originates from sources other than Virtualware 2007 S.A..

The Website www.virtualwaregroup.com does not use cookies, in the sense of data files physically located on the terminal of the User that serve to facilitate browsing on the portal by the User. In any event, Users may configure their Web browsers to prevent such files from being installed.

The purposes of Virtualware 2007 S.A. are to maintain and manage relationships with its Users and to provide information.

In compliance with Instruction 1/1998 of January 19 issued by the Data Protection Agency, to exercise these rights Users must provide proof of identity to Virtualware 2007 S.A. in the form of a photocopy of their national identity cards or any other means recognized in law. However, registration data may be modified or corrected on the Website itself if Users first identify themselves with their user names and passwords.

The User declares that he/she has been informed of the terms and conditions governing the protection of personal data, and hereby accepts and consents to the automatic processing of such data Virtualware 2007 S.A. in the way and for the purposes indicated in this personal data protection agreement.
